1. About BRAK

BRAK is a lifestyle brand offering selected products for people and their dogs, including clothing, accessories, pet products, coffee and other lifestyle products.

By using our website or placing an order, you agree to these Terms of Service and our other applicable store policies.

2. Products and product information

We make every reasonable effort to ensure that product descriptions, photographs, prices and other information on our website are accurate.

Colours and appearance may vary slightly depending on your device or screen settings.

We reserve the right to correct errors and update product information, availability or pricing where necessary.

If an error is discovered after an order has been placed, we will handle the matter in accordance with applicable law and will not unlawfully limit your consumer rights.

3. Orders

When you place an order, you are making an offer to purchase the selected products.

An order confirmation will be sent to the email address provided during checkout.

We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, including an obvious pricing error, product unavailability or suspected fraudulent activity.

If we cancel an order after payment has been received, any applicable refund will be processed in accordance with our Return and Refund Policy and applicable law.

4. Prices and payment

All prices displayed on the website are in South African Rand (ZAR).

Where applicable, prices include VAT.

Payment is processed through the payment method selected during checkout.

BRAK does not receive or store your full card details when payment is processed through a third-party payment provider.

An order will only be processed once payment has been successfully authorised.

5. Shipping and collection

Orders may be delivered using the shipping option selected at checkout.

Standard delivery charges and estimated delivery times are displayed during checkout.

Customers may also select the BRAK – Self-collection option where available. Self-collection carries a R0 delivery charge.

Collection arrangements will be communicated to the customer after the order has been placed.

6. Returns, refunds and defective products

Returns, refunds and defective products are handled in accordance with our Return and Refund Policy and applicable South African law.

Nothing in these Terms of Service is intended to exclude, restrict or limit any consumer rights or protections that cannot lawfully be excluded or limited.

7. Website use

You may use the website only for lawful purposes.

You may not misuse the website, attempt to gain unauthorised access to the website or its systems, interfere with its operation, or use the website for fraudulent or unlawful activities.

8. Intellectual property

The BRAK name, logo, branding, photographs, graphics, text and other original content on this website are owned by BRAK or used with permission.

You may not reproduce, modify, distribute or commercially use BRAK content without our written permission, except where permitted by law.

9. Customer content

If you submit photographs, stories, reviews or other content to BRAK, you confirm that you have the right to submit that content.

By submitting content for publication on our website or social media, you give BRAK permission to use and display that content for marketing and promotional purposes.

We may choose not to publish or may remove customer content where we consider it inappropriate, unlawful or unsuitable for our website or marketing channels.

Personal information provided during the use of our website or when placing an order is handled in accordance with our Privacy Policy.

11. Website availability

We aim to keep the website available and functioning correctly, but we cannot guarantee that the website will always be available or free from interruptions or technical errors.
